Rules for using UGG certification marks, accreditation marks and the MSPO logo.
1Usage rules of certification and accreditation marks (MSPO)
- UGG has established rules for the certification marks it authorises its certified clients to use. The rules ensure, among other things, traceability back to UGG.
- There must be no ambiguity in the mark or its accompanying text about what has been certified and that UGG granted the certification.
- The mark must not be used on a product or product packaging, or in any other way that may be interpreted as denoting product conformity.
- Product packaging is anything that can be removed without the product disintegrating or being damaged.
- Certified clients may not apply UGG marks to laboratory test, calibration or inspection reports or certificates. A certification statement must not imply that the product, process or service is certified.
- Accompanying information is information that is separately available or easily detachable.
- Type labels and identification plates are considered part of the product. A statement on them must in no way imply that the product, process or service is certified.
- A statement must refer to the identity (brand or name) of the certified client, the applicable standard, and UGG as the body issuing the certificate.
- UGG management will use legal means to make sure the certified client:
- Complies with UGG requirements when referring to its certification status in communication media such as the internet, brochures, advertising or other documents
- Makes or permits no misleading statement about its certification
- Does not use, or permit the use of, a certification document or any part of it in a misleading way
- On withdrawal of its certification, stops all advertising that refers to certification, as directed by UGG
- Amends all advertising when the scope of certification has been reduced
- Does not allow reference to its management system certification to imply that UGG certifies a product (including a service) or process
- Does not imply that the certification applies to activities and sites outside the scope of certification
- Does not use its certification in a way that would bring UGG or the certification system into disrepute and lose public trust
- UGG exercises proper control of ownership and acts on incorrect references to certification status, and on misleading use of certification documents, marks or audit reports.
- Action may include a request for corrective action, suspension or withdrawal of certification, publication of the transgression and, where necessary, legal action.
- These rules govern the use of all certificates, certification marks and related marks issued by UGG.
- They also govern any statement about the certification of the management system on product packaging, websites, brochures, promotional material or accompanying information showing that the client has a certified management system.
- Certified clients must comply with these rules.
- At each audit, UGG auditors verify that certified clients use certificates, certification marks and accreditation body marks in line with these rules, and report any nonconformity.
- UGG provides its certified clients with the relevant certification marks.
- Certified clients may use the certification mark in communication media such as brochures, stationery, letters, envelopes and business cards.
- The UGG mark may be used together with the relevant accreditation mark.
- The accreditation mark may not be used on its own, or with any mark or logo not provided by UGG.
- UGG marks may only be reproduced in black, grey or green.
- If the scope of certification does not cover all of an organisation's products, services, locations or facilities, material bearing the mark must not suggest that it does.
- Marks may not be altered or modified. They may be resized, provided the proportions of the whole mark are kept and every feature stays clearly distinguishable.
- Where a mark includes an accreditation number, the number is part of the mark and cannot be removed.
- Under no circumstances may a management system certification mark be fixed to a product, or used in any other misleading way that suggests product, process or service certification. The mark applies only to management system certification.
- Photocopies or electronic copies of the original paper certificate may be in full colour, but must be marked as a copy of the original.
- If the client provides copies of certification documents to others, the documents must be reproduced in full or as the certification scheme specifies.
- The right to use the certification mark cannot be assigned to, or acquired by, any other person, entity or corporation, including through a change of ownership of the organisation, without UGG's prior written consent.
- Correct use of the certificate, the certification mark or accreditation mark and the certification statement is a contractual obligation, monitored at every surveillance and recertification audit.
- For clarification on any of these rules, contact UGG by email or phone using the details on this website.
2MSPO logo usage licence issued by MPOCC
Under the Malaysian Sustainable Palm Oil (MSPO) Certification Scheme, the MSPO logo is licensed by the Malaysian Palm Oil Certification Council (MPOCC).
- As the body that audits an organisation against an oil palm management or supply chain certification standard and grants the certificate, UGG is responsible for verifying the logo user's use of the MSPO logo and related claims.
- UGG carries out verification audits to make sure the MSPO logo and related claims are used correctly.
- UGG reports unapproved or nonconforming use of the MSPO logo and its trademark to MPOCC, which evaluates it and decides whether further action, including legal action, is needed.
- Where a client organisation has entered into a Logo Usage License Agreement with MPOCC, UGG makes sure that:
- The logo user makes the current agreement between the logo user and MPOCC available to UGG during the audit, or whenever needed
- The logo user complies with the rules on the MSPO logo and related claims
- UGG examines the system the logo user uses to record how the logo is used and, for products, the production volumes marked with the logo
- Any unapproved or nonconforming use of the MSPO logo is included in the audit report and audit summary report
- A parent company or headquarters may produce materials for the certified entities under it. Any document that relates only to a subsidiary needs that subsidiary's own logo licence.
- Whenever the MSPO logo is used:
- It is reproduced to the measurements, colours, trademark claims and other specifications in the Logo Reproduction Tool Kit that MPOCC provides to approved logo users
- It carries the logo licence registration number provided by MPOCC
- The logo can be used in two ways:
- On-product: a claim on the label, for example PET bottles, plastic packaging, boxes or drums
- Off-product: a claim in traceability documents (invoices, packing lists, bills of lading), in general documents (company or product brochures) or on signage (at an organisation's premises or at the boundary of an oil palm planted area)
- The MSPO logo can also be used off-product to promote MSPO-labelled products, or to raise general awareness of MPOCC's goals for sustainable oil palm management.
- The client acknowledges that use of the logo is regulated and governed by MPOCC, and controlled and monitored by UGG as a certification body accredited by Standards Malaysia for oil palm management and supply chain certification under the MSPO Certification Scheme. Unauthorised use of the logo is prohibited and may lead to legal action.
- MPOCC may inspect, itself or through a third party, in response to a complaint that the License Agreement is being contravened. If it has been, the client bears the cost of the inspection and any other detrimental effects.
3QMS usage rules of certification and accreditation marks
For ISO 9001 and other management system (QMS) certification:
- UGG has established rules for the certification mark it authorises its certified clients to use. The rules ensure, among other things, traceability back to UGG.
- There must be no ambiguity in the mark or its accompanying text about what has been certified and that UGG granted the certification.
- Product packaging is anything that can be removed without the product disintegrating or being damaged.
- UGG certified clients must comply with these rules.
- For a multi-site organisation, only sites whose activities are within the scope of certification may use the certification mark. The right does not extend to the parent company or to subsidiaries unless they are also included in the certification.
- The UGG certification mark may be used on its own, or together with the accreditation mark that appears on the management system certificate issued to the client.
- The mark used must clearly show the management system for which the client is certified.
- Where a client's quality management system is certified to more than one standard, for example ISO 9001 and IATF 16949, a single mark may be used, with the applicable standards and certificate numbers stated below it.
- Certification marks may be used in literature, stationery and advertising, but not on products or on primary or secondary packaging, nor on laboratory test, calibration or inspection reports or certificates, which count as products in this context.
- The marks must not be used on flags, vehicles or the outside walls of buildings.
- The marks and associated text always keep their relative proportions, though they may be enlarged or reduced uniformly. They must never be so small that the associated text is illegible, and are always used with the associated text.
- Using UGG's name, corporate logo, trademarks or other intellectual property without the prior written approval of the Chief Executive Officer is strictly forbidden.
- A client issued with a Standards Malaysia accredited certificate may use the UGG management system certification mark together with the Standards Malaysia accreditation mark. Wherever the client uses the accreditation mark, it must appear with the applicable management system certification mark and associated text.
- Combined marks are reproduced in white, greyscale or black. A client may reproduce the combined mark in colour only in the colour scheme approved by UGG.
- A copy of the relevant certification mark is provided to the organisation when the certificate is awarded.
- The certified organisation's use of the UGG mark is verified at each surveillance visit. Auditors check that the mark is applied correctly.
- An organisation that wishes to display a mark in a way not described in these rules must ask UGG for advice first.
- Where an auditor finds a mark used incorrectly or its conditions breached during a surveillance visit, the auditor advises the client, requires corrective action, and confirms and records in the assessment report that it has been taken.
- If misuse of marks persists, the certification is suspended, followed by withdrawal, and the organisation must stop using the relevant marks for any reason decided by UGG.
- For clarification on any of these rules, contact UGG by email or phone using the details on this website.
